Sheria Ya Kuzuia Kelele Yaanza Kutumika....Kufanya Sherehe Mtaani, Kupiga Mziki, Kufanya Ibada Kwa Kelele ni Milioni 10


BARAZA la Taifa la Hifadhi na Usimamizi wa Mazingira (NEMC), limeanza kung’ata kwa kutumia kanuni ili kudhibiti uchafuzi wa mazingira kwa kelele na mitetemo. 
Kwa sasa mtu akitaka kufanya sherehe mtaani, kupiga muziki kwa kelele, kuendesha ngoma za kukesha za nusu uchi (vigodoro) au ‘bai koko’ au kufanya ibada kwa kelele mitaani, atapaswa kulipa Sh milioni 10.

Pia, baa na kumbi za starehe za usiku zitakazopiga kelele, zitapaswa kulipa kiasi hicho. 
Aidha, NEMC imesema pia kuwa wale watakaohusika na kelele za migodini za kutumia baruti, kupasua miamba zilizo zaidi ya matakwa ya sheria ya mazingira ya kelele na mitetemo, watapaswa kulipa Sh milioni tano ili kupata kibali.

NEMC imetaka watu kuheshimu kanuni za viwango vya kelele na mitetemo katika maeneo mbalimbali nchini. Imeonya kuwa watakaokiuka, hatua kali zitachukuliwa dhidi yao. Kanuni hizo zimeanza kutumika mwaka jana (2015).

Mkurugenzi Mtendaji wa NEMC, Bonaventure Baya alisema hayo Dar es Salaam jana. Alisisitiza kuwa uchafuzi wa mazingira, unaosababishwa na kelele na mitetemo, umekuwa ukifanyika bila kujali sheria za nchi na sasa watashughulikia suala hilo ipasavyo.

Alisema hivi sasa kanuni za kudhibiti suala hilo, zimekamilika na zimeanza kutumika kikamilifu. Mtu yeyote atakayekwenda kinyume cha kanuni na sheria, atachukuliwa hatua kali. Baya alitoa ufafanuzi kuwa yapo maeneo yenye kelele zaidi ya viwango vinavyoruhusiwa kisheria, ikiwamo maeneo ya migodini.

Alieleza kwamba kanuni zimeweka vigezo na tozo maalumu la kuanzia Sh milioni tano hadi Sh milioni 10, kulingana na eneo na aina ya kelele na mtetemo. Alisema mambo mengine ambayo kanuni zimeweka ni faini kwa kila kanuni itakayovunjwa na kusisitiza kuwa hatua hizo zitachukuliwa ipasavyo.

Kulingana na hatua hiyo ya NEMC, sasa mtu mwenye kutaka kufanya sherehe mtaani, itakayohuisha kelele zitakazosumbua jamii pamoja na majirani zake, ikiwamo muziki maarufu wa ‘kigodoro’, ibada za makanisani zinazozidi matakwa ya kisheria ya uanzishwaji wa makanisa hayo katika jamii, atapaswa kulipa Sh milioni 10 ndipo aruhusiwe kuendelea na shughuli yake.

Kwa mujibu wa NEMC, ruhusa hiyo inayo lipiwa, pia ina muda na viwango vyake, ambapo kila muda husika unapoisha, kelele zinapaswa kupunguzwa ama kuzimwa. Hii inahusisha pia baa na kumbi za starehe za usiku.

Baya aliitaka jamii kuepuka uchafuzi huo wa mazingira wa kelele na mitetemo, ambao watu wengi wamekuwa wakidhani si tatizo. Alitaka watu kuheshimu matakwa ya sheria na kanuni kwa nyakati za mchana na usiku.

“Tumekuwa tukipokea malalamiko kutoka kwa watu wengi, wakilalamikia usumbufu wa kelele na mitetemo kutoka kwa watu wanaoendesha shughuli mbalimbali za kiuchumi na kijamii katika jamii,” alifafanua Baya.

Alitoa angalizo kwa wanaotumia vyombo vya muziki na sauti katika maeneo ya makazi, ambavyo vimeleta madhara kwa afya za watu. Alisema matumizi ya vipaza sauti na vyombo vya sauti kubwa, wanapaswa kuwa na kibali maalumu.

Alieleza kuwa kanuni za kelele na mitetemo, zimeweka vigezo na viwango vya sauti kwa ajili ya kudhibiti uchafuzi wa mazingira katika maeneo ya hospitali, makazi, migodini, kumbi za kijamii, kumbi za usiku za starehe, matangazo, baa na maeneo mengine.

Baya alisema baraza limepata changamoto kadhaa, ikiwamo uelewa mdogo wa jamii kuhusu kiwango cha sauti kinachotakiwa na kisichoruhusiwa na baadhi ya watu kwa makusudi huvunja sheria.

Kuhusu faini, alisema sheria ya mazingira imeweka wazi faini kwa wanaokiuka na kuchafua mazingira kwa kelele na mitetemo. Faini hiyo haiingiliani na tozo la Sh milioni tano hadi Sh milioni 10 lililoelezwa, ambapo mtu anapaswa kulipa si chini ya Sh milioni 50 na si zaidi ya Sh milioni 50 ama kifungo jela.

Kaimu Mkurugenzi wa Usimamizi wa Sheria za Mazingira wa NEMC, Ruth Lugwisha alisema tatizo la kelele na mitetemo, limekuwapo kwa muda mrefu. Alisema tangu kupitishwa kwa kanuni, tayari watu kadhaa wamewajibishwa.


Alisema miongoni mwa waliowajibishwa ni makanisa, kumbi za starehe na baa. Hata hivyo, hakuwa tayari kuwataja wahusika wala maeneo. Alisema uwajibishwaji huo ulihusisha faini, kufungiwa na onyo.
